指由法庭委派在案件进行过程中听取证人证言的人；又指法庭任命的对由于在国外、生病或体弱而不能出庭的证人进行询问的人。询问人只记录询问情况，不能对证人的可靠性发表意见。现在司法实践中，除证人不在管辖区范围外，一般不任命专门的询问人。
