Authority to execute the will is documented in the will as well as the conditions that trigger this authority. Conditions are commonly the will maker’s death, incapacity, or total disability. When more than one person and/or entity fills this role, one can act for all, but all must agree to sell, convey, or transfer real or personal property. The will also specifies the powers needed to take control of stated assets, to fulfill debts, expenses, and taxes from the assets, as necessary. An infant or minor appointed as executor must reach 18 years of age for an issuing of probate.
