It has been sug- gested that the factors to be considered include the nature of the racial hostility, whether the location was public or private, the loca- tion, e.g. a mosque or synagogue, but that a discount might be con- sidered for genuine remorse coupled with a guilty plea and previous good conduct: R v. Saunders [2000] TLR 52. There is a particular and new offence of racially aggravated conduct, which amounts to harass- 324 ratio decidendi ment either intended or which would appear to a reasonable person to amount to harassment causing alarm and distress. Racial aggra- vation is shown by racial hostility at the time of the offence or imme- diately before or after. |
