appropriation n. 1. (in administrative law) The allocation of a sum of money to a particular purpose. The annual Appropriation Act authorizes the issue from the Consolidated Fund of money required to meet government expenditure and allocates it between departments and by reference to itemized heads of expenditure. 2. (in criminal law) See theft. 3. (in probate law) The transfer by personal representatives of a particular asset in satisfaction of a legacy or share of the estate. For example, a testator leaves a legacy of £1,000 to A; part of the estate comprises shares in ICI and, rather than paying A in cash, the personal representatives appropriate shares in ICI to A to the value of £1,000 in satisfaction of the legacy. Personal representatives’ authority to appropriate is conferred by section 41 of the Administration of Estate Act 1925 and requires the consent of the beneficiary (which is normally dispensed with by an express term of the will). |
