bind over An order issued by a magistrates’ court or by the Crown Court directing the person subject to the order to keep the peace or be of good behaviour or by the Crown Court directing the person to come up for judgment. A bind over to keep the peace or be of good behaviour is often used as a means of case disposal in minor cases, whereby the prosecution agrees not to proceed in exchange for the defendant’s agreement to be bound over for a stated period. If the defendant breaks any of the conditions of the order during this period, he will forfeit a specified sum of money. A bind over to come up for judgment may be used as a substitute for sentencing in the Crown Court, whereby the defendant agrees to be bound by certain conditions following conviction. If the defendant breaks any of the conditions, he will be brought back before the court and sentenced. See recognizance. |
