combat immunity The immunity from tort claims arising from loss or damage suffered by military personnel on active service that has traditionally been enjoyed by the Crown (i.e. the Ministry of Defence). Although the specific statutory immunity from torts committed in military action was repealed in 1987, the principle of combat immunity remains well established at common law.
