dangerous driving The offence of driving a motor vehicle in such a way as to fall far below the standard that would be expected of a competent and careful driver, or in a manner that would be considered obviously dangerous by a competent and careful driver (Road Traffic Act 1988 s 2). The maximum penalty on indictment is two years’ imprisonment and/or a fine; on summary trial, it is six months’ imprisonment and/or a fine. Disqualification is compulsory with endorsement of between 3 and 11 penalty points. Forfeiture of the vehicle used may also be ordered (Powers of the Criminal Courts (Sentencing) Act 2000 s 143).
