defective equipment An employer’s duty to provide his employees with a safe system of work, so far as is reasonably practicable, includes the provision and maintenance of safe tools and equipment (including materials) for the job. The employer is liable to an employee injured by a defect in the equipment he provides, even if the defect was due to the fault of some third party, such as the manufacturer of the equipment. This area is heavily regulated by European directives, resulting in, for example, the Personal Protective Equipment Regulations 2002, the Provision and Use of Work Equipment Regulations 1998, and the Work at Height Regulations 2005.
