half-secret trust (semi-secret trust) A trust whose existence is disclosed on the face of the will or other document creating it but the beneficiaries of which are undisclosed, though known to the secret trustee(s). For example, A may leave property in his will to B “to be held on trust on terms that have already been communicated to him.” It is not necessary for the word “trust” to be used. The leading case on half-secret trusts is Blackwell v Blackwell [1929] AC 318. See also secret trust. |
