holiday pay Under the Working Time Regulations 1998 (as amended), all workers are entitled to a period of paid holiday each year. In 2020 holiday entitlement was 5.6 weeks per year, with a pro rata entitlement for part-timers. Agency workers, those with irregular hours, and those working on zero-hour contracts are entitled to the same (Uber BV and others v Aslam and others [2021] UKSC 5, Byrne Bros Ltd v Baird [2002] IRLR 96 (EAT)). Employers are not precluded from including bank holidays in holiday entitlement. An employee who is unable to take his holidays because of sickness is entitled to have his leave entitlement recalculated and may carry forward that period to the next year: Revenue and Customs v Stringer [2009] UKHL 31, [2009] 4 All ER 1205.
