indirect discrimination A form of prohibited discrimination based on any of the nine “protected characteristics” covered by the Equality Act 2010. It occurs where a neutral provision, criterion, or practice is applied to everyone, but the result is to put one group at a particular disadvantage. If it cannot be shown that the application of the provision, criterion, or practice is a proportionate means of achieving a legitimate aim, then there will be unlawful indirect discrimination (Essop v Home Office and Naeem v Secretary of State for Justice [2017] UKSC 27; Homer v Chief Constable of West Yorkshire Police [2012] UKSC 15, [2012] 3 All ER 1287; R (E) v Governing Body of JFS [2009] UKSC 15). |
