negative clearance
A former procedure by which the European Commission determined that an agreement notified to it under the competition rules of the Treaty of Rome was exempt from the rules (see competition law). The procedure for notifying agreements was abolished on 1 May 2004, when businesses themselves were given the right to assess whether the conditions for exemption in the then Article 81(3) (now 101(3)) were met. |
