privity of estate The relationship of landlord and tenant under the same lease; as long as the relationship continues, the landlord and tenant may enforce obligations, such as covenants, under the lease against each other. For example, if L grants a lease to T, but T then assigns his lease to A, L and A have privity of estate. Similarly, if L then sells his reversion to R, R and A now have privity of estate. There is no privity of estate between different leasehold estates. If instead of assigning his lease to A, T instead sublets the property to S, S and L do not have privity of estate. |
