In civil cases in the EUROPEAN COMMUNITIES a degree of uniformity and coherence has been achieved by the Euro- pean Convention on Jurisdiction and Enforcement of Judgments in Civil and Commercial Matters 1968, adopted by the UK in the Civil Jurisdiction and Judgments Act 1982. In CARRIAGE OF GOODS BY AIR cases, the Warsaw Convention makes residence the factor in deciding questions of jurisdiction. Therefore, in an action arising from a con- tract of international carriage that is subject to the Warsaw Con- vention, English courts would have jurisdiction if the residence or

A similar principle applies in CARRIAGE OF GOODS BY ROAD cases where the Carriage of Goods by Road Act 1965 provides that an action may be brought in the courts of the country where the defendant normally resides or has his chief place of business. Alternatively, jurisdiction may lie in the country where the contract was made.
