Before the evi- dence can be relied upon, it must usually also be credible. It is at this stage that a court may believe a witness because he says he saw the accused stab the victim, but the court may or may not rely upon that evidence depending upon the circumstances, such as the prevailing light or weather conditions or state of mind of the witness.
