bail
bail the release of an accused person pending further process, a pro- cedure known in England since the time of Richard III. The court may seek security, in terms of money, or impose conditions. In Eng- land bail is governed by the Bail Act 1976 and the Supreme Court Act 1981. There is a presumption in favour of bail: Bail (Scotland) Act 1980. Money bail is no longer required. The standard conditions in Scotland require the accused not to commit offences and to keep the authorities appraised of his address and to turn up for the callings of the case. Special conditions may restrict the accused from approach- ing the complainer in the case. In both jurisdictions, refusal may be appealed. In both jurisdictions bail need not be granted if there are substantial grounds for believing that the accused would re-offend, interfere with witnesses or abscond. In both England and Wales and Scotland, there are no longer any automatic refusals of bail as a result of a decision of the EUROPEAN COURT OF HUMAN RIGHTS: Caballero v. UK [2000] TLR 144. In some US states there is a bail schedule setting out the amount of bail for each crime.
