Heretofore, in the UK at least, there would have been no liability. The EU law is applied in the UK by the Com- mercial Agents (Council Directive) Regulations 1993 (No. 3053), which came into force on 1 January 1994. The Regulations apply to agents trading as individuals, partnerships or companies. They cover selling agents and buying agents. However, they apply to agents for the sale or purchase of goods, not services. In Scotland, compensation was awarded in one case by a capital sum represent- ing two years' commission following French law: King v. T. Tunnock Ltd [2000] TLR 372; and in an English case those who marketed gas as self-employed intermediaries were held to be entitled to the pro- tection of the legislation; they were not 'secondary agents', who are excluded from protection: Tamarind International Ltd v. Eastern Natur- al Gas Ltd [2000] TLR 499. |
