This replaces the former offence of reckless driving, and the definition of this new offence is very similar to the approach taken by the Scottish courts to reckless driving: Allan v. Patterson 1980 RTR 97. A person is driving dangerously if: (a) the way he drives falls far below what would be expected of a competent and careful driver; and (b) it would be obvi- ous to a competent and careful driver that driving that way would be dangerous. 'Dangerous' refers to damage to person or property. Regard is to be had to circumstances of which the driver could be expected to be aware and also to those of which he can be shown to have been actually aware. |
