transform vb. To convert a rule contained within a treaty, or that is a by-product of a treaty, into domestic law by means of primary or secondary UK legislation. Without such a transformation, the rule cannot be applied as law by a British court. Hence, before the transformation of the UK’s treaty obligations under the European Convention for the Protection of Human Rights by the Human Rights Act 1998, British courts could not directly apply the provisions of the Convention. With regard to obligations under EU law, the term transpose is used in preference to transform. The so-called “doctrine of transformation” is opposed to the doctrine of incorporation. |
