unduly lenient sentence Where it appears that the Crown Court has been unduly lenient in sentencing an offender, the Attorney General may, with the leave of the Court of Appeal, refer the case to that court for review. Only certain types of serious sexual or violent offences can be reviewed (Criminal Justice Act 1988 ss 35, 36). The procedure on referral is set out in Rule 70 of the Criminal Procedure Rules. |
