unfit to plead
In criminal proceedings, describing an accused person who is under a disability (such as mental incapacity) that would constitute a bar to his being tried. The test of unfitness to plead is whether the accused will be able to comprehend the course of proceedings so as to make a proper defence. The relevant procedure is governed by the Criminal Procedure (Insanity) Act 1964. |
