usual covenants Traditionally, the covenants that a good conveyancing practitioner would insert in a lease. When an agreement for a lease does not specify the terms of the lease, there is a term implied in the agreement that the lease will contain the usual covenants. The following are generally accepted as usual: by the landlord, a covenant for quiet enjoyment; by the tenant, to pay rent, to pay tenants’ rates and taxes, to keep the premises in repair, and to allow the landlord to enter to inspect the state of repair. There is also a condition for re-entry for nonpayment of rent. Whether or not any other covenant is usual is a matter of evidence. |
