assent
n. The process under which personal representatives are able to transfer property (real or personal) to a beneficiary of the estate. It is simply an indication by the personal representatives that the property is not needed for the administration of the estate and that the property may pass to the beneficiary. No formality is required for personal property but an assent in writing is required for real property (Administration of Estates Act 1925 s 36). |
