voyeurism n. Under the Sexual Offences Act 2003 (ss 67–68) a person commits the offence of voyeurism if, for the purposes of sexual gratification, he observes another person performing a private act and he knows that the other person does not consent to be observed for his sexual gratification (R v Bassett [2008] EWCA Crim 1174, [2009] 1 WLR 1032). A person is similarly guilty if he records (or uses equipment with the intention of recording) a person performing a private act for the sexual gratification of a third party and the person so recorded does not consent. A private act is defined as one that (a) is performed in a place or circumstances where there would be a reasonable expectation of privacy and (b) entails full or partial nudity, sexual activity, or excretion.
