worker n. Under UK employment legislation, “worker” is a wider category than that of employee. In particular, it may encompass those who would describe themselves as self-employed. The Employment Rights Act 1996 (as amended) s (3), defines a worker as “an individual who has entered into or works under…(a) a contract of employment, or (b) any other contract…whereby the individual undertakes to do or perform personally any work or services for another party to the contract whose status is not…that of a client or customer of any profession or business undertaking carried on by the individual”. Some employment legislation extends to both employees and workers (e.g. the national minimum wage) while some covers only employees (e.g. protection against unfair dismissal). A worker is distinguished from someone in business on his own account because the worker is heavily dependent on the employer for his work. |
