age discrimination The law governing age discrimination was introduced in 2006 and is now found in the Equality Act 2010. Age discrimination is unlawful in employment and (from April 2012) in the provision of goods, facilities, and services. It covers direct and indirect discrimination, victimization, and harassment. However, it differs from the other “protected characteristics” in that direct age discrimination may be objectively justified (e.g. in turning down an application for an HGV licence). There are a range of other exceptions where the general rules will not apply, including age-based concessions and state benefits. There are no longer upper age limits on unfair dismissal and redundancy claims and employers cannot set compulsory retirement ages or force an employee to retire unless such a scheme can be justified as a proportionate means of achieving a legitimate aim (Seldon v Clarkson Wright and Jakes [2012] UKSC 16, [2012] ICR 716). |
