command responsibility
A criminal offence under the International Criminal Court Act 2001. It provides that a military commander is responsible for offences committed by forces under his effective command and control where he knew, or should have known, that his forces were committing such offences and failed to take all necessary and reasonable measures to prevent their commission. |
