distress for rent Formerly, the common law right for a landlord to seize a tenant’s goods to secure payment of rent arrears. If the tenant failed to pay the rent arrears after distress had been levied, the landlord could sell the goods and keep the amount due. The common law right was abolished by the Tribunals, Courts and Enforcement Act 2007 s 71. In the case of a lease of commercial premises, the landlord may use the Commercial Rent Arrears Recovery Scheme governed by the Tribunals, Courts and Enforcement Act 2007 sch 12 to secure payment of arrears of rent. |
