Court Martial
Under the Armed Forces Act 2006, a court convened to try offences against service law. It consists of a legally qualified judge advocate and between three and seven serving officers (depending on the seriousness of the offence to be tried). The court may include warrant officers, provided that the accused is of a rank below that of the court members concerned, and civilian members, if a civilian who is subject to service discipline is being tried. The finding and any sentence awarded are determined by a majority of the votes of the members of the court (the judge advocate has no vote on the finding).

Since 1951 there has been a Court Martial Appeal Court, which consists of the Lord Chief Justice and other members of the Senior Courts. A convicted person may appeal to the Court against the conviction and (from 1 April 1997) against sentence. Either he or the Director of Service Prosecutions may then appeal to the Supreme Court.

When a member of the armed forces is charged with conduct committed in the UK that is an offence under both service law and the ordinary criminal law, the trial may in certain serious cases (e.g. treason, murder, manslaughter, and rape) be held by the ordinary criminal courts (and is in practice frequently held by them in other cases). Provision exists to ensure that a person cannot be tried twice for the same offence. See also Service Civilian Court.
