assault on a police constable in the execution of his duty A person is guilty of a specific offence if he assaults a constable in the execution of his duty, or assaults a person assisting a constable in the execution of his duty (Police Act 1996 s 89). The offender does not need to know that the person he is assaulting is a constable. Although the Police Act 1996 remains in force, CPS guidelines suggest that such assaults should be charged in preference under the Assaults on Emergency Workers Act 2018. |
