duty to consult Modern legislation frequently contains a “duty to consult”. This principally concerns ministers or other authorities, who are required to consult interested persons before making subordinate legislation or exercising other powers. A duty to consult falls far short of a duty to comply with the consultees’ wishes, but, equally, it is also far from an empty duty. It imposes flexible but demanding procedural requirements: to communicate fully; to allow proper time to respond; and to consider carefully any responses received.
