effective date of termination The date on which a contract of employment comes to an end, i.e. the date of expiry of any notice given or of a fixed-term contract or the date of the employee’s dismissal or resignation if no notice is given. However, an employee dismissed without the statutory minimum notice to which he was entitled is treated as having worked for that period after his dismissal for the purpose of calculating whether or not his length of service qualifies him to apply to an employment tribunal in respect of unfair dismissal and in relation to calculating his weeks’ pay and basic award (see compensation; continuous employment). The effective date of termination marks the start of the three month period in which the dismissed employee may present a claim to the employment tribunal.
