fair dismissal Dismissal of an employee when a tribunal decides that an employer has acted reasonably in dismissing the employee and that the dismissal was for a lawful reason, i.e. it was both procedurally and substantively fair (see substantive fairness) to dismiss on the grounds of the employee’s capability, qualifications, or conduct; redundancy; the fact that it would be illegal to continue employing the employee; or some other substantial reason.
