freedom of association Article 11 of the European Convention on Human Rights and the Human Rights Act 1998 protect freedom of peaceful assembly and association with others, including the right to engage in peaceful protests and demonstrations and to form and join trade unions and similar bodies (Wilson v UK [2002] 1 IRLR 568 (ECHR)). It is a qualified right. The state has a duty to protect protesters from those who wish to prevent their assembly or attack them (Plattform Ärzte fur das Leben v Austria (1988) 13 EHRR 204). |
