Guantanamo Bay A naval base situated at the SE end of Cuba: it has been leased by the USA since the Cuban American Treaty of 1903. Since 2002 the military prison at the base has been used as a detention centre for some 780 alleged terrorists and military combatants, mainly captured in Afghanistan and Iraq and held without charge. In June 2008 the US Supreme Court in Boumediene v Bush 553 US (2008) held against the US government with regard to its treatment of certain detainees at the base. The Court held that the Military Commissions Act of 2006 violated the constitutional right of non-US nationals held at Guantanamo Bay by depriving them of a meaningful habeas corpus review by federal civilian judges. Plans to close the facility were announced by the Obama administration in 2009 and the Biden administration in 2021; currently (2021) 40 detainees remain. The last British detainee was released in October 2015. |
