pre-action protocols
Protocols introduced in 1999 to speed up the early parts of the litigation process. Pre-action protocols encourage greater contact between the parties at the earliest possible opportunity in order to encourage better and earlier exchange of information with a view to fair and early settlement of claims. There are now 17 protocols covering:

• resolution of package travel claims

• construction and engineering disputes

• debt claims

• media and communications claims

• personal injury claims

• resolution of clinical disputes

• professional negligence

• judicial review

• disease and illness claims

• housing conditions claims

• housing disrepair cases

• possession claims based on mortgage or home purchase plan arrears in respect of residential property

• possession claims by social landlords

• low-value personal injury claims in road traffic accidents

• claims for damages in relation to the physical state of commercial property at termination of a tenancy (the “dilapidations protocol”)

• low-value personal injury (employers’ liability and public liability) claims

• personal injury claims below the small claims limit in road traffic accidents

Pre-action protocols can be enforced by the court and are seen as an aspect of the courts’ new responsibility of case management under the Civil Procedure Rules.
