pre-action protocols
Protocols introduced in 1999 to speed up the early parts of the litigation process. Pre-action protocols encourage greater contact between the parties at the earliest possible opportunity in order to encourage better and earlier exchange of information with a view to fair and early settlement of claims. There are now 17 protocols covering:

resolution of package travel claims
construction and engineering disputes
debt claims
media and communications claims
personal injury claims
resolution of clinical disputes
professional negligence
judicial review
disease and illness claims
housing conditions claims
housing disrepair cases
possession claims based on mortgage or home purchase plan arrears in respect of residential property
possession claims by social landlords
low-value personal injury claims in road traffic accidents
claims for damages in relation to the physical state of commercial property at termination of a tenancy (the “dilapidations protocol”)
low-value personal injury (employers’ liability and public liability) claims
personal injury claims below the small claims limit in road traffic accidents

Pre-action protocols can be enforced by the court and are seen as an aspect of the courts’ new responsibility of case management under the Civil Procedure Rules.
