implied condition A term or obligation implied by law in a contract, any breach of which will entitle the innocent party not only to damages but to treat the contract as discharged (see condition). In a contract of sale of goods there are implied conditions that the seller has the right to sell the goods, that the goods will correspond with the contract description, and, in the case of sales in the course of business, that the goods are of satisfactory quality and fit for the buyer’s declared purpose. |
