jus in re (real right) [Latin: right in a thing] As opposed to a jus ad rem, which implies only a right to demand delivery or possession of a thing, a right in property that enables the holder of it to vindicate possession against the world. This difference between the right in a thing and the right to a thing is an important one. No one possessed of a jus in re in any subject can be deprived of his right of property therein, except with his consent or by legal process. If it should be stolen from him, he may claim it wherever he may find it, even if it is in the hands of a bona fide purchaser. A jus in re, therefore, is such a real right in property itself as cannot be defeated. |
