just satisfaction The basis for damages awarded by the European Court of Human Rights (and thus in respect of claims under the Human Rights Act1998). In many cases where the Court finds a violation it has declined to award any damages on the basis that this finding is in itself sufficient just satisfaction. Subject to this discretion, damages can be obtained for pecuniary loss, nonpecuniary loss, and costs and expenses. Damages awarded by the European Court of Human Rights are generally smaller than those awarded in domestic courts and rarely exceed £1,000 (plus legal costs). |
