marital breakdown The deterioration of a marriage to such an extent that the court will grant a divorce. The breakdown must be irretrievable. Under the Matrimonial Causes Act 1973 this can be evidenced only by adultery, desertion, living apart, or unreasonable behaviour. By virtue of the Divorce, Dissolution and Separation Act 2020, a statement by one or both parties that the marriage has broken down irretrievably will be taken as conclusive evidence of that fact. |
