obstruction n. The offence of causing or allowing a motor vehicle, trailer, or other object to stand on a road in such a way that it is likely to impede other road users (Road Traffic Act 1988 s 22) or to use a vehicle on the road in a similar way (e.g. by driving unreasonably slowly: Road Traffic Act 1988 s 3). It is unnecessary to show that any other vehicle or person has in fact been obstructed. This offence is punishable by a fine. It is also an offence to leave a motor vehicle on a road in such a position or in such circumstances that it is likely to cause danger to other road users. This offence requires a notice of intended prosecution and is punishable by a fine, endorsement (which carries 3 penalty points under the totting-up system), and discretionary disqualification. |
