protector n. A person appointed by a trust instrument, in addition to any trustees, upon whom rights or powers may be conferred. Such rights or powers are usually concerned with regulating the activities of the trustees in relation to the way in which they carry out the trusts. Although a protector does not have any trust property vested in him, he will usually be concerned to ensure that the trusts are carried out in accordance with the settlor’s wishes. Protectors are rarely used in English trusts but are commonly used in trusts domiciled in offshore jurisdictions, such as the Isle of Man and Jersey. In some places, such as the Bahamas and the British Virgin Islands, the role of protector has statutory recognition. |
