public duties Certain public officers, including magistrates, councillors, school and college governors, and members of health authorities, are entitled under the Employment Rights Act 1996 to time off work to fulfil their official public duties. An employee entitled to time off work for public duties does not have a statutory right to be paid for his periods of absence. In the case of jury service, an employer must allow an employee time off to perform this duty, but the employer can apply to delay the employee’s service if it will have an adverse effect on their business. The employee does not have a right to be paid for time off performing jury service, but many employers do this. Where the employee is rendered out of pocket for their attendance, they may submit a loss of earnings and expenses claim to the court. Failure to attend jury service is contempt of court. |
