publicist n. An international legal scholar or scholarly organization (such as the Institut de Droit International) whose writings are, under Article 38 of the Statute of the International Court of Justice, a subsidiary source for determining rules of international law. These subsidiary sources are stated to include both judicial decisions and “the teachings of the most highly qualified publicists of the various nations”. Classically, in terms of academic writers, such sources would include the writings of Hugo Grotius, often termed the “father of international law”, Van Bynkershoek, Pufendorf, and Vattel. However, it is to be noted that, as a source of law, the International Court of Justice has more frequently turned to writers of the 20th century. The three most frequently cited by the Court are Shabtai Rosenne, Sir Hersch Lauterpacht, and Sir Gerald Fitzmaurice. |
