social action, responsibility, and heroism Under the Social Action, Responsibility and Heroism Act 2015 (SARAH), three criteria that are to be considered by the court in cases of alleged negligence or breach of statutory duty. The Act was brought forward because the government believed that worries about legal liability increasingly had the effect of deterring people from socially useful actions. Under the Act, a court assessing potential negligence and the required standard of care is to have specific regard to: (i) whether the alleged negligence or breach of statutory duty occurred when the person was acting for the benefit of society or any of its members; (ii) whether the person, in carrying out the activity in the course of which the alleged negligence or breach of statutory duty occurred, demonstrated a predominantly responsible approach towards protecting the safety or other interests of others; and (iii) whether the alleged negligence or breach of statutory duty occurred when the person was acting heroically by intervening in an emergency to assist an individual in danger. |
