sovereignty of Parliament The constitutional principle that the legislative competence of Parliament is unlimited. No court in the UK can question its power to enact any law that it pleases. In practice, however, Parliament does not assume unlimited authority; it can legislate only for territories that are recognized by international law to be within its competence, i.e. the UK, the Channel Islands and the Isle of Man, and UK Overseas Territories. The Welsh Assembly, Scottish Parliament, and Northern Ireland Assembly have devolved power in certain areas (see Sewel Convention). In the wake of the UK’s decision to leave the EU, the sovereignty of Parliament over the executive was affirmed by the Supreme Court judgment in * (No. 1)">Miller’s case (No. 1). |
