equitable presumptions
An inference by equity that where a given set of facts exists, this gives rise to the assumption that other facts follow. For example, the presumption of advancement means that a father who makes a voluntary transfer to his child is deemed to have intended to make a gift. Other examples of an equitable presumption include the presumption of a resulting trust and the presumption of equality (see equality is equity). |
