distance selling The sale of goods or services to a consumer in which the parties do not meet, such as sale by mail order, telephone, digital TV, email, or the Internet. Important consumer protections were introduced by the EU Distance Selling Directive 97/7, implemented in the UK by the Consumer Protection (Distance Selling) Regulations 2000, and strengthened by the Consumer Rights Directive 2011/83, implemented in the UK by the Consumer Contracts Regulations 2013. The legislation has been further consolidated by the Consumer Rights Act 2015. In particular, consumers have rights to certain information about the contract to be entered into and, in many cases, the right to cancel the contract within a certain period, usually 14 working days from the day of delivery. The right applies whether the goods are defective or not, but it does not apply in certain important categories (such as auctions, betting, goods specifically made for a consumer, food that will deteriorate, and digital downloads once the downloading process has begun). |
