grave hardship (in divorce proceedings) Previously, if a divorce petition was based on a five-year separation under the Matrimonial Causes Act 1973 s 5(1), the respondent could oppose the grant of the decree nisi on the ground that the dissolution of the marriage would result in grave financial or other hardship and that it would be wrong in all the circumstances to dissolve the marriage. This hardship bar is removed by the Divorce, Dissolution and Separation Act 2020. See also divorce. |
