Upper Tribunal A superior court of record created in 2008 under the Tribunals, Courts and Enforcement Act 2007 as a common means of handling appeals against decisions of lower tribunals. It is the first tribunal to have the power of judicial review. The Tribunal presently consists of four chambers: the Administrative Appeals Chamber; the Tax and Chancery Chamber; the Lands Chamber; and the Immigration and Asylum Chamber. Appeals against decisions of the Upper Tribunal can be made to the Court of Appeal in certain circumstances. In R (Cart) v Upper Tribunal [2011] UKSC 28, [2012] 1 AC 663 the Supreme Court held that judicial review would occur only where the Tribunal had committed an error of law on the face of the record or a procedural impropriety resulting in a denial of natural justice. |
